Letter of Agreement (v.7)

The parties have negotiated clarifications and conditions for disbursement of funds for office hours and health benefits for part0tiem temporary faculty as per Article 18.A.7 and Article 22.G.1. This letter confirms the results of those negotiations. It is subject to review and approval of the PFT Executive Council, PFT legal counsel, and thereafter by the Chancellor and the Board of Trustees.
A. Office Hours (Article 18.A.7)
This Letter of Agreement as to Office Hours applies only to the 2003-04 academic year, unless otherwise agreed between the parties in negotiations toward the successor Collective Bargaining Agreement. At the conclusion of the 2003-04 academic year, the status quo which existed prior to this Letter of Agreement shall be promptly reinstated, unless otherwise agreed between the parties in negotiations toward the successor Collective Bargaining Agreement.
- In the last paycheck at the conclusion of the Fall 2003 semester, the District shall match the effective percentage the State reimbursed in its most recent payment to the District for part-time temporary faculty office hours. The District shall advance the State’s hare as well as pay the matching percentage.
- In the last paycheck at the conclusion of the Spring 2004 semester, the District shall match the effective percentage the State reimbursed in its most recent payment to the District for part0time temporary faculty office hours. The District shall advance the State’s share as well as pay the matching percentage.
- Payment for office hours shall be suspended if the District receives definitive word that the State is cutting off funding for this program. If a dispute exists with respect to whether the State is cutting off funding, the parties will consult in good faith before the District arrives at a final course of action. If funding is restored, or retroactively reimbursed for the semester, then participating part-time temporary faculty shall be retroactively compensated for the funds, in accordance with the formula in A.1.
- The District agrees to submit all necessary applications and information to secure funding, and to pursue State reimbursement in good faith.
B. Health Benefits (Article 22.G)
- For the Fall 2003 semester, participating part-time temporary faculty will pay one half of their health benefits premium. The district will pay the other 50% and seek reimbursement from the State.
- For the Spring 2004 semester, participating part-time temporary faculty will pay 100% of the cost of their health benefits program. The District will seek State reimbursement for the employee premium. If the State reimburses the District, part-time temporary faculty shall be reimbursed the percentage of their payment that the State reimbursed the District. The District agrees to submit all necessary applications and information to secure funding, and to pursue State reimbursement in good faith.
- After the Fall 2003 semester, the District shall cease advancing funds for health insurance premiums for participating part-time temporary faculty, unless the parties otherwise mutually agree. If, during the term of this Agreement, State funds are allocated to the District for the specific purpose of enhancing medical benefits for part-time temporary faculty on a basis that is cost-neutral to the District, the parties shall negotiate over possible use of such funds, with a good-faith intention to reach prompt agreement for implementation.
C. 125 Plan
Starting with the Spring 2004 semester, the District shall establish a 125 plan for part-time temporary faculty, which will permit part0time faculty to tax-shelter health benefits premiums.
